1. Introduction

Yangoods offers you an online purchasing service which allows you to purchase a selection of items, intends to those who would like to save the time from shopping at our physical stores and those who are far from our stores to have convenient and satisfactory experience through our website. You can also benefit from promotions, gifts and exclusive offers. We encourage you to read our “Terms & Conditions” prior to using our website. Your use of website implies your acceptance of generation conditions, rules and regulations and it also indicates that you have acknowledged, understood and agree to adhere to “Terms & Conditions”.

2. Definition and Information of Us

In the terms of pronouns; ‘We’, ‘our’, ‘us’, ‘Yangoods’ mean the seller/owner of this website, Yangoods located at No. (8), Khattar Street, Thiri Khay Mar Ward, Sanchaung Township, Yangon. In the terms of pronouns; ‘You’, ‘your’, ‘yours’, ‘user’ reference to the customers, users or owners of account registered at our website. 3. Website and Account

3.1 To make it easier for you to order products using the website, we offer you the opportunity to register for a personal account or log in through social media. If you take advantage of this opportunity, any personal data that you provide us with during the registration and shipping information process, will be stored in our database and need not be entered with each new order, it will be entered into the order form automatically.
3.2 Before you place orders on the website, you need to register with an account or use social media plugin to log in. You share responsibility for ensuring that the details you provided on registration or at any time are complete and correct.
3.3 When you register for an Insider account, you will be asked to create a password. You must keep this password as confidential. You share responsibility for all activities and orders that occur under your account. You share the responsibility to protect your account information such as password, account detail and related private information. If you found that your password has become known to anyone else or the password is being used in unauthorized manner, we recommend that you change your password immediately if such an incident occurs.
3.4 If someone accesses our website or services using your account information, our system will rely on that account information and will assume that is you accessing the website and services. If you did not make purchase on our website but found the activities or order histories under your account, please inform us immediately.
3.5 You may not transfer your account, benefits and services or share with any third parties. Yangoods will not be accountable for benefit shared problem and other issues. You must keep your user ID and password confidential at all times. You shall not misuse the website by creating multiple user accounts.
3.6 Please fill in full detail of personal information, right address and email address. Update contact information before you make an order. If you use current address as shipping address when making order and change it to a new address later, your parcel will be delivered to given address. If you do not wish to be sent wrong destination, please contact us immediately before shipping out your parcel. If we get informed late while the parcel is on the way to you, there will be changes for delivery charges. You shall therefore provide an accurate, complete and up-to-date account information. You must keep your account information need to be update at all times.
3.7 You are not encouraged to change your email address which has been registered initially. Your amount spent will be calculated into Yangold and changing email address often would not help you save Yangold in one place and able to redeem.

4. Intellectual Property

Yangoods is the owner or the licensee of all intellectual property rights in and to the content of Yangoods website and the material published on it. You are not allowed to copy, modify, reproduce or use for any commercial, business and/or public purposes or made accessible to third parties in any form or by any means without Yangoods’s prior permission. You are solely responsible for obtaining such permission and any copies made of the content must contain a Yangoods copyright notice. Notices of protected rights may not be removed.

5. Plagiarism

All photos and content on our website and social media platforms are works of Yangoods and using of our images for commercial purposes is not allowed. Copyright infringement is dealt strictly and legal action will be taken against resellers who use our content.

6. Availability on the Website

We aim to offer the best service possible but we will not make promise that the service on the Website will meet your requirements. We also can’t grantee that the services will be fault free. If you found any fault in the service, you should report it to our Ecommerce Service Team, we will try to solve the problems as quickly as possible.

7. Product Information

All Yangoods products are made of vegan leather, cotton canvas, canvas and full-grain leather and silk for limited scarves. All types of leather, synthetic and other materials including brass chain, react to humidity and may cause permanent wear and tear. Care should be taken of friction and overexposure to direct light as color fading may occur. When not in use, store in a protective bag in a cool, dry place. 8. Purchase Procedure (Order)

8.1 Select the product you wish to purchase and add them to the shopping cart by clicking on the corresponding icon.
8.2 The shopping basket contains the reference of the selected item, its name, quantity and price. The quoted price does not include shipping (delivery) costs, which will be applied at the checkout.
8.3 To proceed with the purchase, the user’s personal details will be required and will be included on our database in order to process the order and simplify future purchases via the website. The personal details provided by users will be treated in accordance with our Privacy Policy (You may find Privacy Policy at Section 18).
8.4 You may place an order by completing and submitting the order on website. You shall be responsible for ensuring the accuracy of all orders including reward item. Yangoods reminds that delivery address and other personal information must be as accurate as possible in order to avoid any confusion or errors in the dispatch of the item(s) purchased. By confirming your purchase at the end of the checkout process, you agree to accept and pay for the item(s).
8.5 Once the order has been completed and before the order is confirmed, the user will be provided an email with an itemized summary of the order, identifying the item(s) purchased, the total price (including transportation service charges) and the order delivery details, in order for the user to confirm this by clicking on the ‘Continue to payment method’ and ‘Complete order’ button.
8.6 An automated order confirmation email will also be sent to the email address indicated by the user with acknowledgement of receipt, with a description of the order and the personal details provided. If you do not receive this e-mail, this could be due to a temporary communications problem in the network or an error in the e-mail address entered. In both cases, Yangoods advises the user to contact us. Similarly, an e-mail will be sent to the user confirming that the product has been dispatched.
8.7 You can cancel or change your order and personal information before checkout. After placing order, you may not cancel by yourself. If you discover that you have made a mistake regarding to your order or shipping address after submitted, please contact us immediately during Monday to Friday (9:30AM - 6:00PM). If there are public holidays, your order cancellation process may take longer.

9. Misuse or Purpose of Purchase

Yangoods does not limit the amount of purchase however, we strongly permit the purchase of Yangoods products as bulk order in the mean of commercial use and unauthorized resale. Here, unauthorized resale explains, a person buys our products from Yangoods official stores or website and resell in terms of raffle or lottery method. Reselling your old bags and other products as second hand/used is possible to do however, you shall not advertise, offer for retail sale, distribution or export any of the products purchased due to aforementioned reasons. If you wish to make purchase in excess amount or quantity for purposes other than resale (by means of raffle) should contact customersupport@yangoods.com and inform us about various options for making the desired purchase.

10. Right not to accept or cancel an order

10.1 We reserve the right to cancel your order on the following grounds:
10.1.1 due to a lack of availability of product
10.1.2 when we have identified an error in redemption for reward without a coupon code
10.1.3 if we are unable to reach your region/address provided to deliver
10.1.4 when the security systems indicate that the order may be fraudulent
10.2 The confirmation email does not constitute our acceptance of your order; it merely records the fact that we have received the order. If for any reason from above, we will notify you of this by email or inform you via contact number given for order cancellation.
10.3 Yangoods currently offers postpaid system which is payable when only the parcel arrives to you therefore your payment will not be affected when it is cancelled.

11. Delivery

11.1 Your parcel will arrive within 2-3 working days if destination is within Yangon. If you placed an order on weekends and public holidays, it will be processed on next business days. We put effort to deliver our products to you in timely however, there might be a delay due to circumstances beyond our control such as political issues, environmental condition, natural disaster and so on.
11.2 The courier will be in touch with you before delivering to you. If you cannot make available for first attempt, you may respond to them as early as you can and request for reschedule. If failure to do so, the courier will keep your parcel in their storage/warehouse or office for a week (maximum) as a bounced parcel. Bounced parcels that are unclaimed or repeatedly fail to take delivery, will be returned to Yangoods and your order will be cancelled.
11.3 Delivery will be made to the address specified by you on the completed order form. If you have filled an incorrect or incomplete delivery address, a further charge or different fare may be incurred for delivering the products at another time.
11.4 In order to avoid any delivery problems (incorrect addresses, nobody at home, etc.), you must complete the applicable form correctly and it is advisable to leave a contact telephone number in the corresponding field.
11.5 You agree to accept the parcel by signing for the significance of receiving our products.
11.6 The delivery/shipping cost is calculated according to the items purchased and its weight. The exact cost will be calculated every time an item is added to the shopping cart, and will be displayed on the order summary page that appears before you confirm the order.
11.7 Yangoods will waive delivery fees (including for redelivery) if you have received a damaged item due to product defect and would like to return it. However, delivery charges to be incurred by customer if requested to exchange the products.

12. Exchange and Return

12.1 We accept exchange and return for damage that is made within 15 days from date of delivery with valid e-receipt and order number. This policy is applicable only to those products which do not fall in the list of non- refundable items provided on our site. Please see Exchange & Return for more information.
12.2 Jewelry items are exchangeable within 14 days.
12.3 All items must be unused, unworn, unwashed, free of stain and with its tags intact.
12.4 Items must be exchanged with an equivalent or higher price item. Extra payment to be made for higher- price item.
12.5 Delivery fees for replacement item will be incurred by Yangoods for items acknowledged to be defective. If the replacement item is no longer in-stock, you may request to get a new design.
12.6 For damage, if you return within 15 days, we will have a new one for you. After 15 days, we will not replace with a new one however, you still have benefit from free repair service. If product was returned after 60 days or defective by user’s action, there will be a charge for repair.

13. Risk of Loss

13.1 All purchases of physical items from Yangoods are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to carrier. Risk in the products shall pass to Yangoods upon your delivery of the products to the carrier when making exchange or return.
13.2 Yangoods will compensate for item(s) lost while delivering to you. However, the responsibility of lost effect does not rely on returning from you i.e. if you addressed Yangoods HQ wrongly when sending back for exchange/return. Please therefore ensure to fill the correct address if you wish to send the item(s) back to us.

14. Cancellation and Termination

14.1 Yangoods will close or terminate your account if you make too many returns for more than (3) times, sometimes without warning or explanation or prior notice to us. By closing these accounts, Yangoods is trying to protect the experience for all shoppers and prevent long-term abuse of its return policy. The silver lining is we have allowance for reschedule if you are not available to receive your parcel at the time of delivering to you.
14.2 We will also suspend or cancel your account with the website immediately under this condition.
14.2.1 You breach any obligation under these Terms and Conditions
14.2.2 If you were elusive of delivery more than 3 times
14.2.3 If you are using the website for any fraudulent purpose or
14.2.4 You breach any law or regulation in the course of using the website

15. Payment

Yangoods currently accept the payment of Cash-on-Delivery method. Your payment will be made only after delivering your item to you. We have extended the mobile banking payment system via CB, AYA, KBZ, CBPay and KBZPay.

16. Loyalty Program

Members of the Yangoods Insider program earn 1 Yangold (“Point”) for every 1,000 kyats spent on Eligible Product Purchases. Yangold accrue when you create an Insider account at the time of purchase for both in- store and online Eligible Product Purchases. Under the Insider program, “Eligible Product Purchases” means purchases of Yangoods products in which fashion, jewelry and lifestyle items such as bag, scarf, notebook, coaster, accessories and so on. Consignment items such as, Mandalay Watch is excluded. For online purchase, Yangold is counted for product purchased only and shipping cost is not included. The Insider program is free to enroll. There are three eligible tiers of membership; Insider, Emerald Insider and Mahura Insider. The Insider will graduate to the next tier automatically upon meeting the tier’s qualifications. Membership will be expired after 2 years from last purchase date. Yangold that are remained in member's account which is expired will also be forfeited.

Our products are also available for sale in our Yangoods stores. Unless otherwise indicated at the time that you provide your personal information at stores is not provided to us.
